Terms of Service

These Terms of Service ("Terms") govern your use of BacPac AI (the "Service"), operated by BacPac Technologies LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years old and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

BacPac AI is an AI-powered travel planning application that generates personalized travel itineraries based on your inputs. The Service integrates with Google APIs to save itineraries to your Google Drive and to compose emails for sharing.

3. User Accounts

• You must sign in with a valid Google account to use the Service.
• You are responsible for maintaining the security of your account and for all activities that occur under your account.
• You agree to provide accurate information and to update it as necessary.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Use automated systems (bots, scrapers) to access the Service without our written permission.
• Misrepresent your identity or impersonate others.
• Upload or transmit malicious code or content.

5. Intellectual Property

• The Service, including its design, code, branding, and AI models, is owned by BacPac Technologies LLC and protected by applicable intellectual property laws.
• You retain ownership of the content you provide as input (trip details, preferences).
• Generated itineraries are provided for your personal use. You may share them freely, but you may not resell or commercially redistribute them.

6. AI-Generated Content

• Itineraries and recommendations are generated by AI and are provided for informational purposes only.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content, including prices, availability, hours of operation, or safety information.
• You are responsible for independently verifying all travel information before making bookings or travel decisions.
• We are not a travel agency and do not make bookings on your behalf.

7. Third-Party Services

The Service integrates with Google APIs and may reference third-party businesses (hotels, restaurants, attractions). We are not responsible for third-party services, content, or practices. Your use of Google services is also governed by Google's Terms of Service.

8. Service Availability

• We strive to keep the Service available but do not guarantee uninterrupted access.
• We may modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice when possible.
• We are not liable for any downtime or service interruptions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
• WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• IN NO EVENT SHALL BACPAC TECHNOLOGIES LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless BacPac Technologies LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

• You may stop using the Service and request account deletion at any time by emailing privacy@bacpacai.com.
• We may terminate or suspend your access for violation of these Terms or for any reason with reasonable notice.
• Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive (including Sections 9, 10, and 12).

12. Governing Law & Disputes

• These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
• Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Florida.
• You agree to submit to the personal jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new effective date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
